Gun Pulse: Montana considers bill to end all local red flag laws

Montana lawmakers are considering legislation that would prevent local governments from enacting red flag gun confiscation laws used to take guns from residents without due process.

 

Montana Republican State Representative Braxton Mitchell introduced a bill making clear that “extreme risk protection orders violate a person’s right to bear arms” under both the United States Constitution and the state constitution, meaning that local governments cannot “enact, adopt, or implement” a resolution or ordinance enforcing red flag gun confiscation in the state.
