Supreme Court says deportations of suspected gang members can continue

Members of the Supreme Court said on Monday that deportations under the Alien Enemies Act could continue despite District Court Judge James Boasberg recently blocking such moves.

 

The injunction from Boasberg, which tried to block the deportation of five alleged Tren de Aragua members to El Salvador, was nixed in a five to four decision from the Supreme Court, with the three liberals and Justice Amy Coney Barrett ultimately dissenting from the majority.

 

 

Justices declined to answer whether the Alien Enemies Act truly applied to the five individuals deported, but concluded that the lawsuit must be brought in Texas rather than in Washington.

 

“The detainees are confined in Texas, so venue is improper in the District of Columbia,” the majority decision said. “The government is likely to succeed on the merits of this action.”

 

 

President Donald Trump celebrated the decision, remarking via social media on Monday that the Supreme Court “has upheld the rule of law in our nation by allowing a President, whoever that may be, to be able to secure our borders, and protect our families and our country itself.”

Republican lawmakers had attempted to impeach Boasberg for what they contended was a politically motivated decision to block Trump border enforcement efforts. Representative Brandon Gill, a Republican from Texas, filed articles of impeachment against him last month.

 

“We will not stand by as radical activist Judge James Boasberg tramples on the Constitution out of political spite for the President,” the lawmaker asserted. “The American people gave us a mandate to get criminal illegal aliens out of our country, and that’s exactly what we intend to do.”
